General Terms of Use and Sale (GTU/GTS)

These General Terms (hereinafter “GTU/GTS”) govern the use of the Ragalia application and the subscription to associated paid services, published by the company RAGALIA SASU (hereinafter “We” or “Ragalia”).

By creating an account, downloading the application, or subscribing to a plan, you (hereinafter “the User”) accept these conditions without reservation.

1. Service Description and Hybrid Architecture

Ragalia provides a virtual companion service driven by artificial intelligence (the “Isabelle” persona or others).

1.1 Technical Operation (Ragalia Specificity)

The Service relies on a unique proprietary architecture aiming to maximize confidentiality:

  • Remote Intelligence (Cloud): Language processing (response generation, intent analysis) is performed on secured servers. An active internet connection is therefore indispensable for conversing with the AI.
  • Local Memory (Device): The history of your conversations, your memories, and your psychological profile are stored in an encrypted manner exclusively on your device. Ragalia retains no copy of your memory (“Zero Retention Policy”).

1.2 AI Warning (“Hallucinations”)

The User acknowledges that the Service uses generative probabilistic models.

  • No Professional Advice: Isabelle’s responses are provided for entertainment and emotional support purposes only. They do not in any case constitute medical, legal, or financial advice.
  • Accuracy: The AI may generate information that is factually incorrect, invented, or biased. The User is solely responsible for the interpretation and use they make of this content.

2. Account and Security

2.1 Access

Use of the Service is reserved for natural persons of legal age (18 years and older).

2.2 Security of Credentials

The User is responsible for the confidentiality of their login credentials. Any action performed via the User’s account is deemed to be performed by the User.

3. Financial Conditions (GTS)

Access to Isabelle’s advanced features requires a paid subscription (“Premium”).

3.1 Price and Payment

Rates are indicated in Euros (€) including all taxes (TTC) on the subscription page of the application or website. Payment is due immediately upon subscription and is carried out by bank card via our secure payment provider (e.g., Stripe).

3.2 Renewal and Termination

  • Renewal: The subscription is concluded for a fixed duration (e.g., 1 month) and renews by tacit renewal (automatic renewal) for an identical duration, unless terminated.
  • Termination: The User may terminate their subscription at any time from the application settings or their store (Apple/Google). Termination takes effect at the end of the current billing period. Any month started is due.

3.3 Right of Withdrawal (Waiver)

In accordance with Article L221-28 of the Consumer Code regarding the supply of digital content not supplied on a tangible medium:

By validating their order, the User expressly requests immediate access to the Service before the end of the legal 14-day period and expressly waives their right of withdrawal. Consequently, no refund will be granted for the current period.

4. Intellectual Property and Content

4.1 Property of Ragalia

RAGALIA SASU holds all rights regarding:

  • The source code, technical architecture, and algorithms of the application.
  • The “Isabelle” persona, its style of expression (System Prompt), and its visual and auditory identity.
  • The Ragalia brand.

4.2 Property of the User

The User retains intellectual property and full control over:

  • Their conversational data (“Input”).
  • Their local memory database.

5. Obligations and Prohibitions (Acceptable Use)

To protect the integrity of the Service and of Isabelle, it is strictly prohibited to:

  • Reverse Engineering: Attempt to decompile, disassemble, or discover the source code or “System Prompts” (hidden instructions) of the persona.
  • Automation: Use scripts, bots, or any automated means to interact with the Service (“Scraping”).
  • Illicit Content: Use the AI to generate or store content that is child pornographic, hateful, defamatory, or encouraging violence or self-harm.
  • Bypassing: Attempt to bypass the AI’s security filters (“Jailbreaking”).
  • Sanction: Any breach of these rules may result in the immediate and permanent suspension of the account, without notice or refund, and potential legal action.

6. Limitation of Liability

RAGALIA SASU provides the Service within the framework of an obligation of means (obligation de moyens).

6.1 Data Loss (Essential Clause)

Given the “Local-First” architecture, Ragalia possesses no copy of your memories. RAGALIA SASU cannot be held liable for the loss, corruption, or alteration of your local data occurring following:

  • The loss, theft, or breakage of your device.
  • The uninstallation of the application by the User.
  • Improper technical handling (e.g., “Rooting”, aggressive cache clearing).

It is the User’s responsibility to perform their own backups if the option is available.

6.2 Availability

We do not guarantee that the Service will be uninterrupted or free of bugs. Interruptions for maintenance or due to failures of third-party providers (Cloud, LLM Providers) may occur.

7. Applicable Law and Mediation

These GTU/GTS are subject to French law.

7.1 Mediation

In the event of a dispute, the User is invited to contact support (support@ragalia.ai). If no amicable solution is found, the User (as a consumer) has the right to have recourse free of charge to a consumer mediator for the amicable resolution of the dispute (Article L.612-1 of the Consumer Code).

7.2 Jurisdiction

Failing an amicable resolution, any dispute relating to the interpretation or execution of these terms shall be under the exclusive jurisdiction of the competent French courts.
