General Terms of Use and Sale (ToS/GCS)
Original Language: French. In the event of any discrepancy between this English translation and the original French version, the French version shall prevail.
These General Terms and Conditions (hereinafter “ToS/GCS”) govern the use of the Ragalia application and the subscription to associated paid services, published by the company RAGALIA SASU (hereinafter “We” or “Ragalia”).
By creating an account, downloading the application, or subscribing to a plan, you (hereinafter “the User”) accept these conditions without reservation.
Definitions
For the clarity of these terms, the following terms are defined as follows:
Application: The software “Ragalia” available on mobile and desktop download platforms.
Device: Any terminal equipment (smartphone, tablet, computer) connected to the internet, under the User’s control, allowing access to the Service.
Persona: The virtual entity (e.g., “Isabelle”) with which the User interacts.
Sensitive Data: Data potentially revealing the User’s emotional or psychological state, or health information, during conversations.
Service Description and Hybrid Architecture
Ragalia provides a virtual companion service driven by artificial intelligence.
2.1 Technical Operation & Data (“Local-First” Architecture)
The Service relies on a proprietary unique architecture aiming to maximize privacy:
Secure Remote Intelligence (Cloud Enclave): Language processing is performed within an isolated cryptographic enclave (“Confidential Computing”). The User understands that their interactions, including potential Sensitive Data (emotions, confidences), are processed ephemerally in the random access memory (RAM) of this enclave strictly to generate a contextual response, and are subject to no permanent archiving on the server side (“Zero Retention Policy”).
Local Memory (On Device): Your conversation history and your profile are stored encrypted exclusively on your Device’s memory.
Synchronization and Backup (E2EE): Ragalia offers an optional Cloud synchronization relay feature. Data passing through this relay is end-to-end encrypted (E2EE) by the User’s Device using a secret passphrase, guaranteeing a “Zero-Knowledge” architecture for Ragalia.
2.2 AI Warning (“Hallucinations”)
The User acknowledges that the Service uses generative probabilistic models.
No Professional Advice: Isabelle is for entertainment purposes. The responses do not constitute medical, legal, or financial advice in any way. In case of real distress, the User must consult a competent health professional.
Accuracy: The AI may generate factually incorrect or biased information (“hallucinations”). The User is solely responsible for the interpretation and use they make of this content.
Account and Security
3.1 Access
Use of the Service is reserved for natural persons of legal age (18 years or older).
3.2 Security
The User is responsible for the security of their Device and the confidentiality of their credentials. Any action performed via the User’s account is deemed to be performed by them.
Financial Conditions (GCS)
Access to advanced features requires a paid subscription (“Premium”).
4.1 Price and Fee Revision
Prices are indicated in Euros (€) including all taxes (VAT). Payment is due immediately. Revision of the price: Ragalia reserves the right to modify the price of subscriptions. In the event of a price increase, the User will be informed at least thirty (30) days before the renewal. The User may terminate their subscription without charge before the new rate enters into force. Failing this, the new rate will apply.
4.2 Renewal and Termination
Automatic Renewal: The subscription renews automatically for a duration identical to that subscribed (e.g., monthly or annual).
Termination and “Kill Switch”: The User may terminate at any time from the application settings or their store (Apple/Google). Account deletion triggers a security process (“Kill Switch”) that irreversibly erases the local databases on the Device. A simple cancellation of the subscription takes effect at the end of the current period. Any month started is due.
4.3 Prior Information (Chatel Law)
For any subscription with a duration greater than one month, in accordance with Article L215-1 of the French Consumer Code, Ragalia will inform the User by dedicated email, no earlier than 3 months and no later than 1 month before the deadline for termination, of the possibility not to renew the contract.
4.4 Waiver of Right of Withdrawal
In accordance with Article L221-28 13° of the French Consumer Code concerning the supply of digital content not supplied on a tangible medium: The User expressly requests and consents that the execution of the Service begins immediately upon validation of the order. By making this express request (actively collected during the subscription flow), the User formally acknowledges that they lose and waive their 14-day right of withdrawal. Consequently, no refund will be granted for the current period.
Intellectual Property
5.1 Property of Ragalia
RAGALIA SASU holds all rights and trade secrets regarding:
The source code and technical architecture (including enclave and scrubbing algorithms).
The Personality Matrix of the Persona (style, narrative, “System Prompts”).
The Ragalia brand.
5.2 Property of the User & Derivative Content
The User retains ownership of their conversational data (“Input”) and their local database. However, the User acknowledges that the customization of the Persona (via their memories or settings) confers no intellectual property right over the Persona engine itself, its base personality, or its underlying mechanisms, which remain the exclusive property of Ragalia.
Obligations and Prohibitions (Acceptable Use)
It is strictly prohibited to:
Automation & Scraping: Use scripts, bots, crawlers, or any other automated means to access the Service, interact with the AI, or extract data (“Data Scraping”).
Reverse Engineering & Injection: Attempt to decompile the application, extract “System Prompts,” or practice prompt injection to corrupt the AI’s behavior.
Bypassing Filters and Relays: Attempt to bypass personal data scrubbing mechanisms (Scrubber), security filters, or abuse the bandwidth of the cloud synchronization relay.
Illicit Content: Use the AI to generate illegal content (child pornography, incitement to hatred, violence, terrorism).
Any breach will result in the immediate suspension of the account without refund and may be subject to legal proceedings.
Limitation of Liability
RAGALIA SASU provides the Service under an obligation of means (best-efforts basis).
7.1 Local Data and E2EE Backups
Backup Responsibility: Since Ragalia does not hold any default copy of your data due to the “Zero Retention” architecture, it is the User’s responsibility to perform backups (via the application’s E2EE system or iCloud/Google Drive).
Loss of Secret Passphrase (Zero-Knowledge): In the context of using the “Zero-Knowledge” synchronized backup service (E2EE), RAGALIA SASU has no access to the User’s secret passphrase. The User acknowledges and accepts that the loss of this secret passphrase will result in the irreversible and permanent loss of their backed-up data. RAGALIA SASU’s liability cannot be engaged under any circumstances in this regard.
Exclusion of Hardware Liability: RAGALIA SASU cannot be held liable for the loss or corruption of local data occurring following the loss, theft, breakage, or malfunction of the Device, or following an uninstallation of the application.
Liability Cap: Except in cases of gross negligence, willful misconduct (dol), or bodily injury, Ragalia’s liability for any proven direct damage is limited to the total amount paid by the User during the twelve (12) months preceding the generating event.
7.2 Force Majeure and Third Parties
Ragalia’s liability cannot be engaged in the event of unavailability due to failures of third-party providers (Enclave Hosts, LLM Providers) essential to the Service, or any other case of force majeure.
Applicable Law and Mediation
These ToS/GCS are subject to French law. For more information on how we handle your data, please refer to our Privacy Policy.
8.1 Mediation
In the event of a dispute, the User is invited to contact support (support@ragalia.ai). In accordance with the provisions of the French Consumer Code regarding “the consumer dispute mediation process”, after having solicited us and failing a satisfactory response, you have the possibility to use a consumer mediation procedure free of charge with:

8.2 Jurisdiction
Failing amicable resolution, any dispute shall be under the exclusive jurisdiction of the competent French courts.
